Consumer Rights in Germany for Online Shopping and Second-Hand (2026)

Consumer rights Germany online shopping guide: 14-day withdrawal, no shop return right, 2-year warranty, Kleinanzeigen scams, and Black Friday.

TL;DR: Consumer rights Germany online shopping law gives you 14 days to withdraw from an online purchase from a business, with no reason needed (BGB §312g, §355). In a physical shop there is no legal return right for items that work; returns are goodwill. Every new item from a business has a 2-year warranty, and a defect that appears within the first year is presumed to have existed at delivery (§477). Private sellers on Kleinanzeigen can exclude warranty. Use Sicher bezahlen or PayPal goods and services, never Friends and family.

Consumer Rights in Germany for Online Shopping and Second-Hand (2026)

Consumer rights Germany online shopping law is strong, but it differs from what many students expect. Online purchases can be returned without a reason. Shop purchases cannot, unless the shop chooses to allow it. Private second-hand sales often come with no warranty at all.

This is the detailed article behind where to buy what in Germany. It covers second-hand marketplaces first, then the law.

TL;DR

Where you bought Return without reason Warranty for defects
Online, from a business Yes, 14 days (§312g, §355) 2 years (§438)
In a shop, from a business No legal right; goodwill only 2 years
Used goods from a business 14 days if online Can be shortened to 1 year by explicit agreement (§476)
From a private seller No Can be excluded (§444)

Kleinanzeigen second hand Germany

Kleinanzeigen (eBay Kleinanzeigen until May 2023) is the main second-hand marketplace in Germany. You can buy anything from bikes to full kitchens, and the "zu verschenken" category had about 173,000 free listings on 4 October 2026.

Kleinanzeigen Sicher bezahlen fee

Kleinanzeigen Sicher bezahlen fee for buyers is €0.50 plus 4.5% of the price. Sellers pay nothing.

How it works Detail
Money held Until you confirm you received the item
No action Released to the seller after 14 days
Protection covers Not shipped, significantly not as described, fake, wrong item, incomplete

Kleinanzeigen Betrug: scam patterns

Kleinanzeigen Betrug (scam) patterns repeat. Kleinanzeigen's own advice is "Stop, question, protect":

  • Fake "Kleinanzeigen" messages with a payment button that leads to a phishing page
  • Requests to pay by Western Union, PaySafe, MoneyGram, or cash in an envelope
  • PayPal "Friends and family" instead of "Goods and services"
  • A seller who refuses pickup or keeps changing the meeting place
  • Prices far below market, with pressure to pay today

Meet in busy places for local pickup and check the item before paying. Source: Kleinanzeigen safety advice.

Furniture specifically: furnishing a student room.

Refurbished phone Germany

A refurbished phone Germany shops sell often beats any student discount. The shops add their own guarantee on top of the legal warranty.

Shop Guarantee Returns
refurbed at least 12 months 30 days
Back Market 12 months 30 days
rebuy 3 years on electronics 21-day withdrawal
Apple Certified Refurbished 1 year Apple policy

Compare prices on idealo or Geizhals before buying new or refurbished. Geizhals shows price history and wish lists. Student pricing on new devices: student discounts.

Widerrufsrecht 14 Tage: online withdrawal right

Widerrufsrecht 14 Tage (the 14-day withdrawal right) applies to distance contracts with a business, which covers online shops, phone orders, and doorstep sales.

Rule Detail Law
Period 14 days, no reason needed §355
Start When you receive the goods §356
If not informed Right lasts up to 12 months + 14 days §356
Refund Within 14 days, including cheapest standard shipping, same payment method §357
Return shipping You pay only if the seller told you before the purchase §357

Exceptions (§312g): custom-made goods, perishable goods, hygiene-sealed items once opened, and sealed software or media once opened.

The withdrawal right does not apply to purchases from private sellers.

How to withdraw from an online purchase

  1. Check the date you received the goods. Day 1 is the day after delivery; you have 14 days.
  2. Send a clear withdrawal statement to the seller: email, the shop's form, or their return portal. Returning the parcel alone may not be enough; say you withdraw.
  3. Keep proof of the date you sent it.
  4. Return the item in the period and keep the shipping receipt.
  5. Expect the refund within 14 days of your withdrawal. The seller may wait until the item arrives back or you prove you sent it.

Return policy Germany store

Return policy Germany store rules start from a surprise: a shop has no legal duty to take back goods that work. Returns are goodwill (Kulanz), and the shop can limit them, for example to a voucher (Verbraucherzentrale Hamburg).

Common voluntary policies:

  • IKEA: 365 days, unused, with receipt
  • MediaMarkt: 30 days from receipt
  • Amazon.de: 30 days to request a return (online, on top of the legal 14)

Ask before paying: "Kann ich das umtauschen oder zurückgeben?" Keep the receipt; businesses must issue one (AO §146a).

Gewährleistung 2 Jahre: warranty for defects

Gewährleistung 2 Jahre (two-year statutory warranty) protects you when an item is defective, whether bought online or in a shop.

Rule Detail Law
Period 2 years from delivery §438
Burden of proof Defect within 1 year presumed to exist at delivery (was 6 months before 2022) §477
Used goods from a business Can be shortened to 1 year only by explicit, separate agreement §476
Private sellers Can exclude warranty ("Privatverkauf, keine Gewährleistung") unless they hid a defect or gave a guarantee §444

The statutory warranty is against the seller, not the manufacturer. A manufacturer's guarantee (Garantie) is voluntary and comes on top.

Payment protection

Method Protection
PayPal "Goods and services" Buyer protection; report within 180 days of payment, escalate within 20 days
PayPal "Friends and family" No buyer protection
Kleinanzeigen Sicher bezahlen Escrow until receipt
Bank transfer to a stranger Very hard to recover

Black Friday Germany fake discounts

Black Friday Germany fake discounts are limited by law. Under PAngV §11, a shop advertising a reduced price must state the lowest price it charged in the previous 30 days. A "was €199" that only applied for a day last year is not allowed.

  • Black Friday 2026: 27 November. Cyber Monday: 30 November.
  • Germany no longer has legally fixed summer and winter sales (abolished in 2004), but shops still hold sales at similar times.
  • Use idealo or Geizhals price history to check whether a deal is real.

Cancelling subscriptions

Contracts that can be signed online must also be cancellable online through a clearly labelled button ("Verträge hier kündigen", BGB §312k). This covers streaming, gyms that sell online, and mobile contracts. Free trials convert to paid automatically; set a reminder.

Common mistakes

  • Assuming a shop must accept a return of a working item
  • Returning an online parcel without sending a withdrawal statement
  • Paying a Kleinanzeigen seller by Friends and family
  • Accepting "keine Gewährleistung" from a business on new goods
  • Throwing away the receipt
  • Trusting Black Friday "was" prices without checking price history
